In a press release published on July 11, 2019, the General Court of the European Union announced “confirmation of the inclusion of Bisphenol A [BPA, CAS 80-05-7] as a substance of very high concern on account of its properties as a substance toxic for reproduction.” This is the latest update in a legal proceeding between industry association Plastics Europe and the European Chemicals Agency (ECHA) regarding consideration of information about intermediate uses of BPA when it was listed as a substance of very high concern (SVHC) in 2017. The court determined that “the use of a substance as an intermediate is not relevant, since the information relating to that use does not concern the intrinsic properties of that substance whereas the identification and inclusion of a substance in the candidate list of substances are carried out solely on account of the intrinsic properties of a substance and not on account of the uses of that substance.”
