On September 2, 2015 the European Chemicals Agency (ECHA) published the Article 95 list of active biocidal substances including the respective substance or product suppliers. Under Article 95 of the Biocidal Products Regulation (BPR), a biocidal product cannot be made available on the EU market unless either the substance supplier or the product supplier is included in the Article 95 list. The purpose of the list is to “ensure the equal treatment of persons placing active substances on the market.” The deadline for enforcement of the Article 95 list was September 1, 2015. By the deadline, ECHA has received 158 applications and so far concluded positively on 99 and negatively on 3. ECHA will update the Article 95 list regularly.
