In an article published on January 23, 2019 by law firm Keller and Heckman LLP, a new amendment to chemical law in Taiwan is presented and discussed, including an additional focus on ‘chemical substances of concern’. Now renamed as the ‘Toxic and Chemical Substances of Concern Control Act’, the Act expands “the original five chapters and 44 articles to eight chapters and 75 articles” and specifically adds a new chapter on the “evaluation, prevention, and administration of chemical substances of concern.”
The Act also revises requirements for substance registration, including requirements that can be placed on manufacturers or importers of chemicals that meet the agency’s definition of ‘substance of concern’. These can include providing additional hazard information, reporting regularly on operations, or prohibiting or restricting operations. While some aspects of the Act have already come into force, the majority will take effect on January 16, 2020.
